The Patan Appellate Court, where cases of terrorist activities against the Maoist leaders were filed, has asked the government to furnish details on the latter’s “case withdrawal” requests, published reports said Friday.
The court order followed a government request that it wants to withdraw a case against Maoist leader Bamdev Chhetri filed under the Anti-terrorist Act. Chhetri was among the three whom the government released this week to make a “conducive environment for talks” and to “implement the agreements of the second round of peace talks.”
“The Appellate Court has asked the government whether it wants to withdraw case against Chhetri only,” reports said, quoting court officials. “Since this is a joint case against Chhetri along with talks negotiator Dr. Baburam Bhattarai and central leader CP Gajurel, it is not practical to withdraw Chhetri’s name only,” reports said, quoting court sources.
“On legal basis, the government has the right to withdraw the whole case against Chhetri, Bhattarai and Gajurel.” Government filed the case against the three for attacking police posts and killing people.
