Supreme Court Justice Rajendraraj Nakhwa has resigned following a controversial order issued by him, court sources said.
The apex court judge ordered the government to give a businessman privileged facilities to import sugar by paying only 10 percent customs duty like the National Trading Limited (NTL). The order was issued on the basis of a copy of a government communication presented to the court by the trader.
The government notification had not been gazetted. The development comes at a time when the Supreme Court objected to moves to bring in legislation in parliament to empower the Commission for the Investigation for the Abuse of Authority to investigate judges; the Court argues that such a move would infringe on the independence of the judiciary.
