A Supreme Court decision taken Thursday now requires all Indian workers working in factories and other sectors in Nepal to acquire work permits.

Though the Indian nationals working in Nepal had argued that they need not seek work permit to work in Nepal on the basis of the facilities given by the 1950 Nepal-India Treaty of Peace and Friendship, the court had instructed the government to initiate the necessary steps towards reviewing provisions in the treaty and the Labour Act to issue work permit for Indians.

The instruction had been given in the year 2053 BS. Despite efforts to follow the instructions in 2057 BS, the government had its hands tied after the Indian nationals filed a writ petition at the Supreme Court challenging the recommendations made by the court for the issuance of work permit.
