A day after the Election Commission announced the final results of the CA polls, dispute has surfaced over how the 26 members should be nominated.
According to the interim constitution, the cabinet would nominate these members but what is not clear is whether it is the current cabinet or the new one.
In a Law Day function on Thursday, Chief Justice Kedar Prasad Giri opined that new cabinet is entitled to take decision on that matter while justice Anup Raj Sharma clarified there are no constitutional hurdles on the current cabinet to take the decision. Sharma heads the Constituent Assembly Court.
Speaker Subash Nemwang also hinted in favour of the current Koirala cabinet taking the decision. He said the new government should be formed only after the first sitting of the constituent assembly.
According to constitutional provisions, the first sitting of the assembly need to be called by May 28.
