Judiciary must execute its work in accordance with the changing situation: CJ Poudel

Chief Justice Dilip Kumar Poudel has said that the judiciary should execute its work in accordance with the changing situation of the country.

Talking to journalists in Biratnagar on Saturday, Chief Justice Poudel said justice should be timely and execution of it should be made by imbibing the norms and values of the judiciary, adding, “Justices should offer justice to the people while taking in mind the present condition.”

In response to a query, he said the court cannot look into purely political issues but can comment if the people raise questions over it.

He stressed on the need for the Justices to be alert and change themselves as per the situation of the country and warned that the image of the court would be tarnished if people’s wishes were not understood on time.

At the present time, when the 1990 constitution is inactive and draft of interim constitution is being formed, Poudel said that the judiciary has been functioning as per existing laws. “Judiciary should also keep abide by the laws passed in the parliament.”

The CJ said the courts of law should issue verdicts after analysing the constitution, the laws, precedents and the generally accepted theory of law.

When asked about the role of Supreme Court in the present context in the country, Poudel said the government forms law and the court has to follow it.

He also said that actual justice can be offered only after careful study of the constitution, proof, other laws and established principles.
